Last Will and Testament

In the name of God Amen. I James Patterson of the County of Tyler and State of Virginia being weak in body but of sound mind and memory do make this my last will and testament in manner and form as follows that is to say.

First

I desire that all my just debts and funeral expenses be justly paid out of my outstanding money or any money I may die posesed of.

Secondly

After the payment of my just debts and funeral expenses if there should be any money left I give & bequeath the same with all my real and personal property at my decease to my beloved wife Abigail Patterson during her natural life and while she remains my widow and she devides the personal property among my heirs as she may think proper at her death.

Thirdly

After the death of my wife Abigail Patterson, I give and bequeath to my son Jacob Patteson the farm on which I now live by his paying my heirs by my present wife the sum of Twenty Dollars each named as follows Hannah Bee David Patterson Susannah Patterson Peggy Patterson and to Elizabeth Phillips I have given Twenty five dollars in the price of land purchased of me by her husband Edward Phillips.

Fourthly

It is my will and desire that my son Jacob Patterson do pay or cause to be paid the sum of Twenty five to each of the above named heirs and within three years after the death of his mother.

Fifthly

I give and bequeath to my heirs by my first wife James Patterson Mary Dover Robert Patterson Josiah Patterson Elenor Cornelius one Dollar each to be paid in two years of my death by my Executors.

Sixthly

I will and bequeath my Rifle gun to my granson James Patterson(of Josiah) And lastly I do hereby constitute and appoint my worthy friend Henry Flesher and my son Jacob Patterson Executors of this my last will and testament in witness where of I have hereunto set my hand and affixed my seal this fourth day of April in the year of our Lord One Thousand eight hundred and forty five.

Tyler County Court July Term 1846 This last will and testament of James Patterson deceased was presented in court and the acknowledgment of the said James Patterson thereto was proven by the oaths of Eli Wells and Ducket Wells. In Subscribing witness to the same and the said last Will was Thereupon ordered to be recorded for the last will & Testament of the said James Patterson.
