Regular Monthly Town Board Meeting

Minutes of JULY 15 , 2010

 

The Regular Monthly Town Board Meeting was called to order at 7:00 p.m. by Chairperson, Mike Julson.  All Town Board members were in attendance. The Pledge of Allegiance was recited and the meeting was in compliance with the Open Meeting Law.  Leo Musiedlak moved to certify agenda posting and approve the agenda for this meeting, seconded by Brad Seiler. M/C.  Minutes of the Regular Monthly Town Board meeting of June 17, 2010 were approved with a motion by Seiler/Musiedlak. M/C. The financial report as of June 30, 2010 includes the following balances:  NOW checking-$1,883.14, Berry Ridge Parking fees-$4,484.23, M/M savings-$100,501.53 and Certificate of Deposit-$25,268.93, motion to approve by Musiedlak/Seiler. M/C. 

OLD BUSINESS:

It was recommended with a motion made by Seiler/Musiedlak for Adams County to approve another rezone for Clarke & Bonita Petersen of 3876 First Lane for the remaining 32.58 acres of the 34.58 acres to be zoned A3, the 2 acres previously separated off will be R1-LL.

NEW BUSINESS:

A 5 (five)  year Fire Protection Services  Agreement with the Kilbourn Fire Department  was approved with a motion by Musiedlak/Seiler with a few minor revisions, such as a five year contract instead of ten, the $2,000 annual donation for the ladder truck will now be placed in a rural vehicle replacement fund and over the next five years the allocation percentage for costs will decrease by 2% for the Town of New Haven, from 19.5% to 17.5%. M/C.  A variance to allow for a reduced setback from the waterline was requested  from Paul & Betty Kiszkan at 158 Grouse Ct. Private, Adams County Shoreline Protection Ordinance requires a 75 ft. setback, being that the size of the Kiszkans’s lot is small and all the houses along the water in this neighborhood are set back approximately the same distance from the water, with some being a bit closer or further, the setback would be approx. 52ft., motion by Musiedlak/Seiler to recommend to Adams County to approve the variance.  Mr. Kitszkan states that he is just a few days away from receiving his sanitary permit for a holding tank.  Two variances for Daniel G. Zinke for property owned at 4105 4th Drive were reviewed, the first being allowed to exceed the 8,000 sq. ft. impervious surface of the parcel and the second variance to allow to exceed the maximum building height of 20 ft.  The 40’ X 110’ building would cover more than 20% percent of parcel and exceed detached accessory structure height by 4’.  Mr. Zinke had Adams County Land and Water Conservationist do an onsite visit to the site prior to this meeting because of water run-off concerns.  Matt Bremer stated that no water should leave the property even in a 50 year rain event, and waived the requirement for a storm water permit with conditions that are attached to the variance request.  Moved by Musiedlak/Seiler that it be known to Adams County that the Town of New Haven does not object to these requests. M/C.  An application for a residential driveway on Gillette Avenue for Clarke & Bonita Petersen that was viewed prior to this meeting was approved requiring a 12” culvert.  This permit will be granted upon the approval of the CSM by the Plan Commission regarding this land division.  A proposal by D.L. Gasser Construction, of Baraboo, WI for improvements to 3rd Ave. and Golden Ct. to 2nd Lane (on both sides of the newly installed culvert in Big Spring Creek) in the amount of $10,557 was accepted with a motion from Musiedlak/Seiler.  M/C.  A proposal for improvements on 2nd Lane was also up for consideration, according to Chairperson Julson this project needs to be revised, no action on the second proposal was taken at this time, it will be placed on the August regular monthly Town Board agenda.  It was decided  by the Plan Commission at it’s most recent meeting of July 12, 2010, to recommend to the Town Board, to have the Municipal Attorney review the Land Division Ordinance to be in compliance with the 2009 Wisconsin Act 376, the Act requires that local land division ordinances incorporate the newest revisions no later than January 2, 2011.  If the protections are not incorporated into the local ordinances, they will be unenforceable.  Motion by Musiedlak/Seiler to approve the review. M/C.  A letter of resignation, to become effective August 28, 2010, from the transfer-site attendant, Virgil List was read by Town Chair Julson.  Motion by Musiedlak/Seiler to accept the resignation and appoint Phil Mayer as a replacement, effective August 29, 2010 at $11.00 per hour, he will be placed on a one year probation with a possible wage increase at that time. Mr. Mayer was advised that the Adams County Waste Department recommends that he have  tetanus  and the Hepatitis B series shots.  Sam Wollin a candidate for Adams County Sheriff introduced himself and briefly spoke about his qualifications and changes he would like to implement in the department if elected.  Disbursements  were read by the Town Clerk and accepted for payment with a motion by Seiler/Julson. M/C.  This meeting was adjourned at 8:10 p.m. until August 19, 2010 at 7:00  p.m. with a motion by Seiler/Julson.  M/C.
