TB minutes 8-27-11

TOWN OF NEW HAVEN, ADAMS COUNTY, WI

 

REGULAR MONTHLY TOWN BOARD MEETING, SATURDAY, AUGUST 27, 2011- 3:00  P.M.

 

The rescheduled  Regular Monthly Town Board meeting was called to order at 3:00 p.m. by Chairperson Mike Julson with all Town Board members present.  Pledge of Allegiance was recited.  This meeting was properly noticed and a motion was made by Brad Seiler/Lenny Watson to accept the agenda as printed for this meeting.  M/C.  Minutes of the Regular Monthly Town Board meeting of July 21, 2011 were read by the Town Clerk and approved with a motion from  Seiler/Watson. M/C.  The financial report as of July 31, 2011 was given by the Town Treasurer with the following  balances :  NOW checking account: $4,429.52 , Berry Ridge Parking Fees: $5,617.25, Money Market:  $14,734.00, Tax Collections account-Closed  and CD: $19,394.82, approved by Watson/Seiler. M/C.

 

Old Business:

A follow-up call was placed to Planning & Zoning on Friday, August 26, 2011 on the Complaint of Violations that were filed on July 22, 2011 regarding the properties in the municipality that were renting out residential homes by the day or week.  Mr. McLaughlin stated that he is understaffed at this time and hasn’t had an opportunity to look into the situations.  He also stated that if there were no complaints about the properties that they may be grandfathered in as a Legal Conforming Use.  The Clerk reminded him that this is how the properties came to the Board’s attention as there were complaints, his opinion at this time is to contact the owners and have them apply for a Special Exception and the Town would be able to place conditions before approval.  Mr. McLaughlin recommended the Town to seek legal counsel regarding possible implementation of Room Taxes.  Chairman Julson has had no time to look into sign prices from a Madison firm.

 

 

New Business:

Rezones requested by Mike & Bonnie Julson of 4115 County Road G for 2.4 Ac. From A1-35 to R1-LL and .84 Ac. From A1-35 to R1 was granted with a motion made by Watson/Seiler.  M/C.  The Board members, prior to this meeting observed the area on 4th Drive where Jay & Rian  Hammerly applied to install a driveway.  The driveway will need to have a culvert installed and was approved by Seiler/Watson. M/C.  On Tuesday August 23, 2011 the Town Board was informed that an operation in the municipality removing vast amounts of clay and being transported over the Town’s roads and Town of Douglas roads in Marquette Co.  to  Milk Source east of Grand Marsh was occurring with no permits.  The Town Board agreed to ask Dale Reichhoff,  since he was retired, if he would have time to investigate the operation.  Adams Co. Planning & Zoning and Land and Water Conservation were approached and no permit had been applied for or granted and one was definitely required.  Both departments followed Mr. Reichhoff to the site just east of First Lane where the property owner informed the County that he was digging a pond.  Both departments failed to believe this explanation because of 25-30 dump trucks loading and returning to be loaded.  There was no designated route for these trucks to take and immediately Town of Douglas had weight limits posted on their roads as there was considerable damage going out to County Road A in Marquette Co.  New Haven has two areas that will need to be repaired for almost $1,000 per an estimate  from Mr. Reichhoff.  The trucking company will be contacted and billed accordingly.  At 4:00 p.m. on Wednesday, August 24, 2011 the operation was  shut  down by the County  Departments and the Sherriff’s Office was notified.  Several days later  Mr. Reichhoff checked the New Haven Town Roads in the event that they had  brought the equipment through the woods and loaded it in New Haven, doing further road damage, but there was no evidence observed.  At the present time there have been no applications for permits received for the continuation of soil removals at the County or Town levels.  Mr. Armson who earlier requested to be placed on the agenda was not present.

 

During Public Input/Comment time Matt Hernandez inquired from the Town Board if he could acquire permission to cut some fallen limbs in the road right-of-way on Gillette Ave. and County Road G.  The Board informed him that County G did not fall under our jurisdiction and he would need to seek permission from the land owner on Gillette before doing so.

  Motion by Seiler/Watson to  approve  the  disbursements  as  presented.  M/C.    This meeting was adjourned at 3:50 p.m. until September 15, 2011 at 7:00 p.m. with a motion by Seiler/Watson.  M/C.
