Gilmer county, West Virginia "The last will and testament of Hezekiah Stout of the Coun ty of Gilmer and State of Virginia. Considering the uncertainty of this mortal life and bein g of sound mind and memory, do make and publish this my last will and testament in manner an d form following that is today first I give and bequeath unto my wife, Mary Stout, if I shoul d die first my farm where I live so long as she stay on it if she the said Mary does not sta y on said farm and take care of my youngest son Samuel S. Stout or ---? he is able to take ca re of her. She is not have it any longer but if she continues to live on said farm during he r natural life she is have it as long as the said Mary Stout live with as much of the househo ld and kitchen furniture as I have hereafter mention to wit: namely two big kittles [sic] , 2 ovens and 2 skillets and one tea kittle [sic] and all the Cobert ? ware, all the bucket s belonging to the house, too [sic] _____ and two high posted bead [sic] steads with sufficie nt bedding to keep her warm, one wooden clock, one bay mare named Prince, one saddle and brid le, ___ ___, one named black trading sow, choice of all the black sows. The property above me ntioned is not to be removed off the farm and at her death are the above mentioned property t o belong to my youngest son Samuel Smith Stout and the above mentioned farm also or sooner i f she the said Mary do not continue to live on the farm during her natural life. [W]henever s he leaves the farm all the above mentioned property and farm I will to my son Samuel Smith St out and one dark bay horse named Ball (?) with all my farming utensils and windmill and one b reeding sow, one new saddle and bridle worth $15 Dollars. N.B. the land all lying (?) on on e side of the river. That is to say on the southeast side of little Kenawy [sic] River at o r near the mouth of Big Sliding Hill run and so a part of the tracts of land one hundred acre s deaded [sic] to me from Daniel Stout and one hundred acres deaded [sic] to me from George K eaner and one 50 acre tract I have got a patent from the Commonwealth. The land before mentio ned is a part of the above mentioned tracts and all lying on the above mentioned side of th e said river. "Secondly I will a certain peace [sic] or parcel of land lying at the upper en d of my land and joining lands with Thomas Stout where I first settled on the same river abov e mentioned and being a part of two hundred acres above first described and bounded as follow eth: Beginning at the river bank at a large chestnut sprout marked as or for a corner, thenc e a easterly course a straight line to a mulberry near the turnpike road thence crossing sai d road a straight line with three trees mentioned to Huddblenals (?) Road thence with said ro ad to Huddssenals [?} line on Bares thence with said line to my first hundred acres mentione d from Scott to me thence with my upper line in Southwesterly course to the river bank at th e mouth of a small stream or sink with bank of said river. Thence down said river with the me anders there of a northwesterly direction to the beginning to have the same be it more or les s I will it all to my son Perry Green Stout. "Thirdly, if I should any money or bonds or note s not collected or any other property not mentioned herein I wish it all to be sould [sic] af ter my death and after paying all debts and funeral expenses the remainder when collected t o be equally devided [sic] with all my children that may be alive at that time. In witness wh ereof, I herewith set my hand and seal the thirteenth day of August one thousand eight hundre d and fifty six.
